Who Stops Unauthorized Trash Haulers Entering a Subdivision if the Subdivision Opted Out of The County’s Program

Rich Tucker from Towne South Subdivision spoke at the recent subdivision trustees networking meeting discussing the question of who is responsible to keep unauthorized trash haulers out of their subdivision if their subdivision opts-out of the County’s program. Rich sent us a clarification of this question from Joe Hunt, St. Louis County.

The County will enforce the non-poaching by trash haulers for their assigned districts only. Any subdivision that opts-out will have to enforce that limitation on haulers. It is completely the responsibility of the trustees to keep unauthorized haulers out of their subdivision, if the subdivision opted out of the trash district. Enforcement options could include lawsuits, liens and/or all authorized actions outlined in the subdivision’s protective covenants.
