Appeals court rules St. Louis County residents must pay for curbside recycling

A state appeals court in St. Louis on Tuesday ruled against a group of St. Louis County residents who had claimed that being forced to pay for curbside recycling pickups that they did not request violated the state Hancock Amendment, which requires a public vote on new taxes.
The residents, who live in unincorporated areas of the county, sued the county in 2009. A county circuit court ruled against them; Tuesday's decision upheld the trial court's ruling.
The county set up the trash districts in 2008 and required all residents of unincorporated areas to contract with waste haulers for a "minimum level of service," which was to include weekly trash and recycling pickups.
The case had been before the Missouri Supreme Court. The supreme court sent the case back to the appellate court after it ruled in favor of the county in a separate suit that challenged the county's creation of the trash districts. The high court ruled that establishment of the districts was within the county's authority.

AHH! There’s nothing like justice, not in St. Louis County anyway. And increasingly, in the state of Missouri. We have government of the bureaucrats, by the bureaucrats , and in spite of the people. The vision of government the founding fathers intended has perished from the earth.
ReplyDeleteSt. Louis County showed total disregard for the residents, the private companies, those who worked for years building buisnesses, and no regard for competition or customer preference.

I just saw a story this morning that the ACLU has filed a suite against a Missouri college for requiring drug testing of it’s students and staff, they do maintenance work on equipment that could put many lives in danger if not done properly. Apparently keeping everybody safe is a violation of some people’s civil rights. I guess the ACLU doesn’t consider forcing people to buy services they don’t need or want, recycle pickup, trash service, health insurance, isn’t a violation of our rights as taxpaying citizens. Hurray for justice!!!!! It’s a good thing that we have laws because we sure don’t have any justice
ReplyDeleteWe have wars that have raged on for years in Iraq and Afghanistan, not to mention our involvement in the overthrow of Quadafi in Libya, all in the name of overthrowing heavy handed, oppressive governments. How long will it be before we are forced to do the same thing in the USA? Don’t our “leaders” study history. If they did they would see that the United States is overextending itself and overspending in the same way Ancient Rome did. And if they think our fate will be any different their kidding themselves.

ReplyDeleteWe are not smart enough to choose our own vendors, make our own decisions, decide what we want or how much to pay, so we elect knuckleheads to make those decisions for us.
Again, we deserve the government we elect.
